TX HHS Form 0065.  Information Regarding Authorized Electronic Monitoring for Nursing Facilities

The Texas Health and Human Services (HHS) Form 0065 provides information regarding authorized electronic monitoring (AEM) for nursing facilities. According to Subchapter R of the Health and Safety Code, residents or their guardians or legal representatives are entitled to conduct AEM.

To request AEM, individuals must complete the Request for Authorized Electronic Monitoring form, obtain consent from other roommates using the Consent to Authorized Electronic Monitoring form, and submit the forms to the facility administrator. The resident's physician determines capacity to request AEM, and a legal representative may be appointed if the resident lacks capacity. Additionally, residents or their guardians can designate a person to act as their legal representative for requesting AEM.

The Texas HHS Form 0065 also outlines who may consent to AEM, including other roommates, guardians, or legal representatives. Nursing facilities are prohibited from refusing admittance or discharging a resident due to a request for AEM. If such an incident occurs, it should be reported to the local office of Long Term Care-Regulatory at the Texas Health and Human Services Commission (HHSC).
