Guardianship is a legal relationship established when a person or institution named in a will or appointed by the court is tasked to take care of minor children or incompetent adults, which is also sometimes referred to as conservatorship. To become a guardian, someone appeals to the court to appoint them as the guardian, and this could be a family member, close friend, or a local official responsible for the welfare of a minor. Guardianship of minors remains under court supervision until the child reaches 18 years of age. Although someone being named as a guardian in a will may be interpreted as a preference, the judge is not obligated to grant the request. Guardians should not profit at the expense of the person they care for, and in many cases, payments to the court on a periodic basis are required. In some states, if a child is of a certain age or older, the court must appoint a person nominated by the child if the court finds that the nomination is in the best interest of the child. The court cannot appoint a person against whom a child has filed a written objection. In adult care, judges are often required to make reasonable efforts to consider the preferences of people with disabilities when choosing a guardian. The judge usually does not have to follow the wishes of the person, but must give due consideration to the preferences of persons with disabilities.
A guardianship of the child takes away the right of parents to make decisions about the life of their child. However, it does not permanently terminate parental rights. This means that although the guardian has custody and responsibility for child rearing, the parents are still the legal parents of the child.
The court may allow parents to visit or contact their child, but the court may also impose limitations or other conditions on the visit, such as requiring that any visits be supervised. The frequency and duration of parental visits are up to the guardian (or court) to decide. In some cases, parents can restore custody of their child if the court determines that it is in the best interest of the child.
Local laws vary, but many courts require certain stakeholders to be given notice of the guardianship hearing. Such notification must often be legally served on the person, with a sworn statement from that person, and the service later returned to court as proof of such service. At least one state provides a proxy for emergency care. In Massachusetts, the law allows a parent or guardian to appoint a short-term emergency proxy of a minor without court intervention. This should be done by a written instrument signed by the department, at least two witnesses who are 18 years or older, and the proxy must also sign the document.
Temporary custody is generally granted by the courts to achieve specific objectives within a certain period of time. Once the goal is achieved, the guardianship is terminated.
A plenary guardian is a person appointed by the court with the authority to exercise all legal rights and responsibilities on behalf of the ward after the court makes a finding of disability. This includes taking care of both the person and property of the ward.
State statutes define mental and physical disability. However, as a rule, such disability requires serious and long-term conditions that impose greater restrictions on the ability of people to take care of themselves, to express themselves verbally, to earn a living, and to live independently. The guardian will be granted only those powers necessary to perform tasks that the ward cannot do independently. These powers may include providing care for the ward, ensuring that educational and medical services are adequate, and providing updates to the state court about the ward's situation. The updates must describe the living conditions of the ward, their mental and physical health based on medical examinations and official records, a list of services provided to the ward, a description of the services rendered by the guardian, the funds of the ward, and any other information required by the court to assess the condition of the ward and the responsibilities of the guardian.
